Terms of Service

These Terms of Service govern your use of PhotoResto. By placing an order, you agree to these Terms and confirm that you understand the nature of our custom digital photo-processing service.

1. Service Description

We provide custom digital photo restoration, enhancement, retouching, colorization, aging, and related image-processing services using AI-assisted workflows and human quality checks where applicable. Each order is created specifically from the file(s), selected options, and instructions submitted by the customer.

2. Eligibility and Legal Use

You must use the service lawfully and only submit content that you own or are legally authorized to process. You are responsible for ensuring that your uploaded content and instructions do not violate copyright, privacy, publicity, consumer-protection, criminal, or other applicable laws.

3. User Content Rights

You retain ownership of uploaded files. You grant us a limited, non-exclusive license to host, copy, store, process, modify, and transmit the uploaded files solely as necessary to provide the ordered service, perform support, maintain security, prevent abuse, and comply with legal obligations.

4. Custom and Variable Nature of the Service

Our services are custom digital services. Results depend on source image quality, scan quality, damage level, lighting, resolution, selected options, historical limitations, and the technical behavior of the tools used. We do not guarantee that a result will match a customer's purely subjective preferences, personal memories, or imagined original details.

5. Scope of Order

The scope of each order is limited to the options, examples, and instructions presented at checkout or otherwise expressly accepted by us. A delivered result will be treated as conforming to the order if it materially matches the purchased processing scope, even if reasonable artistic, tonal, color, detail, or restoration differences remain.

6. Prohibited Content

Illegal, infringing, malicious, deceptive, abusive, hateful, or otherwise unlawful content is prohibited and may be rejected, suspended, or removed. We may refuse any order that appears unlawful, fraudulent, technically unsafe, or outside the supported scope of the service.

7. Pricing and Payment

Pricing is shown before checkout. Final files are delivered after successful payment through supported payment processors, unless the checkout flow explicitly states otherwise. By completing payment, you authorize us to begin the ordered processing in accordance with the selected service options.

8. Corrections and Support Window

If the delivered result materially differs from the purchased scope, one reasonable corrective pass may be requested within the support window stated on the website or in the Service Policy. A corrective pass is limited to bringing the result closer to the purchased scope and does not include unlimited revisions, new creative directions, or a new order.

9. Refunds, Subjective Dissatisfaction, and Chargebacks

Refunds are not available solely because a customer dislikes a subjective, stylistic, or aesthetic aspect of a delivered result that materially matches the purchased scope. Customers agree to contact support first and allow a reasonable opportunity to review the order and, where appropriate, provide a corrective pass or other resolution before initiating a chargeback or payment dispute. This clause does not limit any mandatory statutory consumer rights.

10. Right of Withdrawal and Electronic Delivery

By placing an order, you expressly request that we begin performance of this custom digital service before the end of any statutory withdrawal period. You acknowledge that, where permitted by applicable law, the right of withdrawal does not apply or may be lost once the service has been fully performed and/or digital content resulting from the order has been supplied electronically with your prior express consent and acknowledgment. This does not affect any mandatory rights relating to non-conforming service, failed delivery, duplicate payment, or defects required by law.

11. Delivery and Timelines

Delivery times are estimates and can vary due to queue size, technical conditions, payment verification, anti-abuse checks, and image complexity. Delays alone do not automatically entitle a customer to a refund or chargeback if the order is still processed within a reasonable operational period.

12. Warranty and Liability

We provide services with reasonable professional care, but AI-assisted outcomes may vary and are not guaranteed to match subjective expectations exactly. To the maximum extent permitted by law, our liability in connection with any single order is limited to the amount paid for that order. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

13. Evidence of Order and Delivery

For security, dispute handling, fraud prevention, and legal defense, we may retain records showing the order configuration, selected options, timestamps, communications, payment status, preview or thumbnail references, delivery status, and access or download logs. Such records may be used to verify authorization, fulfillment, and the scope of the purchased service.

14. Updates and Contact

These Terms may be updated for legal, technical, or operational reasons. The version published at the time of order will generally apply to that order unless a change is required by law. Contact details are available in the website footer.
